By using the Dr. Moose Customiser (the “Service”), you agree to the following Terms and Conditions. Please read them carefully before proceeding.

1. Use of the Service

1.1 You may use the Service to create custom t-shirt and hoodie designs for personal and non commercial purposes.

1.2 By uploading or creating content through the Service, you warrant that you have full rights and permissions to use all images, text, logos, or other content provided.

1.3 The Service is intended for lawful and respectful use only. All content must comply with these Terms and applicable Australian laws.

2. Content Guidelines

2.1 You agree not to upload, create, or use any content that:

• Infringes any copyright, trademark, or intellectual property rights
• Contains nudity, pornography, or sexually explicit material
• Promotes hate speech, racism, sexism, or discrimination
• Defames, harasses, or harms any individual or group
• Encourages illegal activity or violence
• Is otherwise deemed inappropriate at the sole discretion of Dr. Moose

2.2 Dr. Moose reserves the right to refuse or cancel any order that breaches these guidelines.

3. Intellectual Property and Copyright

3.1 You confirm that you own or have secured all necessary rights to any uploaded content, including images, text, or logos.

3.2 By uploading content, you grant Dr. Moose a non exclusive, royalty free, worldwide licence to use that content solely for the purpose of fulfilling your order.

3.3 Dr. Moose is not responsible for verifying ownership of uploaded content. You are solely liable for any claims, disputes, or damages arising from unauthorised or copyrighted material.

4. Indemnification

4.1 You agree to indemnify and hold harmless Dr. Moose, its employees, contractors, and affiliates from any claims, damages, or legal actions arising from:

• Use of your uploaded content
• Breach of these Terms
• Third party intellectual property claims

5. Order Fulfilment and Limitations

5.1 While we aim to deliver high quality products every time, Dr. Moose reserves the right to modify or cancel orders if content breaches these Terms.

5.2 We are not responsible for design errors resulting from customer supplied content, including low resolution images, spelling mistakes, or layout choices.

6. Prohibited Uses

6.1 The Service must not be used to create counterfeit or imitation goods.

6.2 You agree not to use the Service to produce items for resale that infringe trademarks, logos, or other proprietary rights of third parties.

7. Termination of Use

7.1 Dr. Moose reserves the right to suspend or terminate access to the Service without notice if these Terms are breached.

8. Liability Disclaimer

8.1 Dr. Moose is not liable for any indirect, incidental, or consequential damages resulting from use of the Service.

8.2 Maximum liability for any claim relating to the Service will not exceed the total amount paid for your order.

9. Governing Law

9.1 These Terms are governed by the laws of Australia. Any disputes will be resolved exclusively in Australian courts.

10. Acceptance of Terms

10.1 By using the Service, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

11. Right to Refuse Printing

11.1 Dr. Moose reserves the right to refuse to print any t-shirt or hoodie if the content breaches these Terms or is deemed inappropriate.

12. Customer Responsibility for Design Accuracy

12.1 Dr. Moose does not check spelling, image placement, or design layout. Customers are solely responsible for ensuring their design is correct before submitting an order.

13. No Exchanges for Incorrect Size Selection on Custom Tees and Accessories

13.1 As all custom tees and accessories are printed to order, Dr. Moose does not accept exchanges or returns due to incorrect size selection. It is the customer’s responsibility to review the size guide before ordering.

13.2 Returns or refunds will only be considered if the product is faulty, such as a manufacturing defect, or if the incorrect item was sent due to an error by Dr. Moose. In this case, we will cover return postage and replace the item at no additional cost.

14. Data Privacy

14.1 Images uploaded to create custom designs are not permanently stored.

Finished designs are temporarily saved for 48 hours if added to cart, and securely stored for up to 2 months if purchased, on encrypted servers for reordering convenience.
